General Liability

GL responds to the bodily injury claim. Educators legal liability responds separately if the claim also alleges the teacher failed to follow proper safety protocols — two distinct exposures that need two distinct coverages.

A former teacher files a wrongful termination suit against the headmaster and two board members personally.

Employment-related claims against individual board members are a D&O exposure, not a GL exposure. Without D&O, board members defend personal assets. With it, the carrier defends and the board members' personal finances are protected.

A parent alleges a staff member had an inappropriate relationship with their child. The school is named alongside the individual.

What insurance does a private school in California need?
California private schools need at minimum general liability, sexual misconduct/abuse coverage, directors and officers insurance for the board, educators professional liability, and workers compensation for all employees. Schools that operate vehicles or use personal vehicles for field trips also need commercial auto or hired/non-owned auto. Is sexual misconduct coverage required for private schools?
Most accreditation bodies in California now require it explicitly, and it should be considered essential for any school with staff-student contact. Standard general liability policies exclude sexual misconduct claims. This is a separate endorsement or policy — not an add-on to GL. Does D&O coverage protect school board members personally?
Yes — that is exactly what it does. Without D&O, board members who are named personally in a lawsuit must fund their own defense and pay any judgment from personal assets. D&O coverage pays defense costs and any resulting settlement or judgment. Volunteer board members face the same exposure as paid directors under California law.
Our accreditor requires minimum insurance limits — what are they?
Minimum limits vary by accreditation body. WASC, ACSI, and other California-recognized bodies each have their own requirements. Bring your accreditation agreement to your advisor call — we will confirm your current coverage meets what is actually required, then issue a certificate with the correct wording.
Are student injuries covered by the school's general liability policy?
Student injuries on school premises or during school-sponsored activities are covered by GL, subject to your policy form and limits. Claims that also allege negligent supervision, inadequate instruction, or failure to maintain safe conditions may involve educators legal liability in addition to GL. Do we need separate coverage for sports programs?
Yes — interscholastic sports, martial arts, swimming, and other athletic programs carry elevated liability exposure.
